Grace Period [INSS]: What is it and how long does it endure?

What does the term “Period of Grace” refer to?

During the grace period, individuals can keep their INSS coverage even if they are no longer making contributions.

During this time, the person still has the opportunity to receive pension benefits like disability pension, temporary disability assistance, and survivor benefits.

The grace period will not be included in the calculation of deadlines for pension benefits or as contribution time.

If the insured does not work for pay but wants their contribution time to still count, they must sign up as an optional insured and begin making contributions.

The insured individual must be connected as a voluntary insured if the grace period has ended and they have not yet returned to work to prevent losing their social security coverage.

This system is in place to safeguard the policyholder in case contributions are temporarily halted due to reasons such as unemployment or withdrawal, ensuring that they maintain their entitlements from their contributions.

Distinguishing between insured quality and grace period

Insured quality and grace period are separate concepts, although they are connected.

Who qualifies for the Grace Period?

All INSS members can benefit from the complimentary period, as long as they fulfill certain conditions.

  • Formal and self-employed workers are required to have made previous contributions to the INSS to be eligible for insurance.
  • Provisional insurance requires you to make regular payments before you can pause your contributions.
  • Workers who have been unfairly terminated may be eligible for an extension of benefits if they can demonstrate unemployment insurance or involuntary job loss.

How long does the Grace Period endure?

The deadlines for ensuring the quality of coverage remain the same, no matter the level of contributions.

  • Insured individuals are covered for benefit enjoyment without a deadline, except in cases of accident aid (Article 15, Section I, Law No. 8,213/91).
  • Insured individuals who stop working and do not receive unemployment benefits can be covered for up to 12 months after they stop contributing.

The duration can be prolonged for an additional 24 months if the policyholder has made over 120 consecutive monthly payments (Article 15, Section 1, Law No. 8.213/91).

12 additional months are granted to unemployed individuals who can prove their situation through registration with the appropriate Ministry of Labour and Social Security entity (Article 15, Section 2, Law No. 8,213/91).

Article 13, II of Decree no. 3.048/99 allows for a 12-month period after disability benefit discontinuation.

  • Insured individuals with mandatory isolation due to highly contagious diseases are covered for up to 12 months after the isolation ends as per Article 15, section III of Law No. 8,213/91.
  • An inmate can be held for up to 12 months after being released.
  • Insured individuals are enlisted in the military to serve up to 3 months after being licensed (Article 15, section V, Law No. 8,213/91).

Those who perform mandatory military service and are already insured are also subject to this rule.

  • Optional insurance can be selected up to 6 months after contributions have stopped according to Article 15, section VI, Law No. 8,213/91.

The deadlines start from the month after the most recent contribution.

How to determine the Grace Period?

To determine the grace period, one must consider the most recent contribution and the individual’s current circumstances.

The standard rule states that the insured’s loss of quality will happen on the 16th day of the second month after the grace period ends.

Let’s consider a real-life situation:

Joana was employed as a professional housekeeper until March 2023 when she was unjustly dismissed. She made contributions to the INSS for a continuous period of 15 years.

  • Last participation occurred in March 2023.
  • Joana, with over 120 months of contributions and proof of unemployment, can receive a 36-month grace period.
  • From April 2023 to March 2026.
  • Joana can keep the quality of insurance and may be eligible for benefits from INSS if she fulfills other legal conditions during this time.
  • The insured’s benefit and quality will be lost on April 16, 2024.
